AOL Anti-Spam Lawsuit Dismissed -Lawyers
Tue December 30, 2003 06:28 PM ET
LOS ANGELES (Reuters) - A federal judge has dismissed a lawsuit by AOL against a group of Florida computer technicians that the leading Internet provider charged with helping deliver spam e-mails, lawyers for the technicians said on Tuesday.
Albo & Oblon, the firm representing the technicians, said Claude Hilton, chief judge for the U.S. District Court in eastern Virginia, dismissed the suit last Wednesday.
The firm said the judge found that Virginia courts did not have jurisdiction over the Florida-based defendants, even though AOL, a unit of Time Warner Inc. (TWX.N: Quote, Profile, Research) , does business in Virginia and the unwanted e-mails were directed there.
A spokesman for AOL was not immediately available for comment. The company has aggressively backed federal laws and other industry efforts designed to curb the flow of spam, which has emerged as a scourge in email inboxes.
