hsf writes "On April 26th 2004 Man’s Best Friend Software broke the rules and terms of use it maintains for it’s own site and harvested all the data of the WWW.GSSHWWDB.ORG in spite of the fact that a disclaimer was posted. I noticed the harvest two days afterwards by glancing at our log files. I asked MBFS to remove the database and did receive a response which I can provide. Tamburo has also harvested the hard work of many other individual's databases that they compiled over several years, his claim is “no one posted a disclaimer or had metatags in place to prevent robots access”.
Our database holds a vast majority of our dog breed the Greater Swiss Mountain Dog pedigrees online, our database is over 15,000 dogs. We use a free program from Alfirin Technologies to load the data to our site. Man's Best Friend Software copied all of our data and that of several other breeds, many of their databases much larger then ours. Man's Best Friend sells our data by offering a monthly charge for access. My question is what rights if any do we have? And or what are the best ways to prevent further data harvesting? Besides harvesting data the Man’s Best Friend site owner prides himself as a self proclaimed attorney, his site is loaded with terms of use, the most offensive stating: you agree to them by merely visiting his site.
